El 27 de diciembre de 1512, en
España, se promulgan las Reales Ordenanzas dadas para el buen regimiento y
tratamiento de los indios, más conocidas como 'Leyes de Burgos'. Fueron
firmadas por Fernando 'el Católico', y se consideran precursoras de la
Declaración de los Derechos Humanos.
En estas leyes, se concluyó que el
Rey de España tenía justos títulos de dominio del continente americano y que el
indio tenía la naturaleza jurídica de hombre libre con todos los derechos de
propiedad. No podía ser explotado, pero como súbdito debía trabajar a favor de
la corona. Se esforzaron en establecer una minuciosa regulación del régimen de
trabajo, jornal, alimentación, vivienda, higiene y cuidado de los indios con un
sentido tuitivo, altamente protector y humanitario. Las mujeres embarazadas de
más de cuatro meses eran eximidas del trabajo.
Las Leyes prohibieron terminantemente
a los encomenderos la aplicación de todo castigo a los indios, el cual se
reservaba a los visitadores establecidos en cada pueblo y encargados del
minucioso cumplimiento de las leyes.
Las ordenanzas, imbuídas del
catolicismo imperante en la corte española, impulsaron la evangelización de los
indios y ordenaron su catequesis, condenaron la bigamia y les obligó a que
construyeran sus bohíos o cabañas junto a las casas de los españoles. Este
conjunto de leyes tuitivas que la corona de España dictó hacia los naturales
fue un importante adelanto y también precedente para el derecho del trabajo que
se consolidó recién a nivel global en el siglo XX
El ámbito de implantación de las
'Leyes de Burgos' comenzó por la Isla de La Española, para extenderse más tarde
a las islas de Puerto Rico y Jamaica. Posteriormente se aplicarían en tierra
firme (actual Venezuela), por iniciativa de Fray Pedro de Córdoba.
A pesar de las ordenanzas, la
población indígena de las Antillas, siguió disminuyendo principalmente por
enfermedades, sin embargo, algunos sacerdotes como Bartolomé de Las Casas,
creyeron que se debió a las condiciones de trabajo, teoría que utilizaron y
manipularon a su favor.

THE LAWS OF BURGOS 
On December
27, 1512, in Spain, the Royal Ordinances given for the good regiment and
treatment of the Indians, better known as 'Laws of Burgos', are promulgated.
They were signed by Fernando 'el Católico', and are considered precursors of
the Declaration of Human Rights.
In these
laws, it was concluded that the King of Spain had fair title deeds of the
American continent and that the Indian had the legal nature of a free man with
all property rights. He could not be exploited, but as a subject he had to work
for the crown. They strove to establish a meticulous regulation of the work
regime, wages, food, housing, hygiene and care of the Indians with a
protective, highly protective and humanitarian sense. Pregnant women over four
months were exempted from work.
The Laws
strictly prohibited the encomenderos from applying any punishment to the
Indians, which was reserved for the visitors established in each town and in
charge of meticulous compliance with the laws.
The
ordinances, imbued with the Catholicism prevailing in the Spanish court,
promoted the evangelization of the Indians and ordered their catechism,
condemned bigamy and forced them to build their bohíos or cabins next to the
houses of the Spaniards. This set of protective laws that the crown of Spain
dictated towards the natives was an important advance and also a precedent for
labor law that was recently consolidated globally in the 20th century.
The scope of
implementation of the 'Laws of Burgos' began with the Island of Hispaniola, to
later extend to the islands of Puerto Rico and Jamaica. Later they would be
applied on the mainland (present-day Venezuela), at the initiative of Fray
Pedro de Córdoba.
Despite the
ordinances, the indigenous population of the Antilles continued to decline,
mainly due to diseases; however, some priests, such as Bartolomé de Las Casas,
believed that it was due to working conditions, a theory that they used and
manipulated in their favor.
